| 摘 要： | 为探讨新工程合同（ NEC）在内地推广的可能性，通过文献综述，概述 NEC 的特征及组成结构，以内地建设工程合同借鉴的 FIDIC 条款为例，分析 NEC 在工期、成本、质量管理方面的优势。根据对香港发展局工务部门成员及 NEC 项目相关负责人的访谈，重点总结 2009 年以来 NEC 在香港工程建设领域的应用情况，分析顺利开展 NEC 项目的要素，以及阻碍其推广的因素。从合作理念转变、试点项目选择、合同应用语言、团队成员配置四方面，提出在内地建设实践项目中应用 NEC 的相关建议。

| Abstract: | To explore the possibility of promoting new engineering contract (NEC) in the Mainland of China， the features andstructures of NEC were summarized based on a literature review. Then the advantages of NEC in the schedule， cost， and qualitymanagement were analyzed by taking the FIDIC terms borrowed from mainland construction contracts as an example. Theapplications in Hong Kong， the elements for the successful implementation， and the challenges hindering the promotion of NECsince 2009 were summarized based on the interviews with members from the Development Bureau and managers of NEC project.Finally， some suggestions on the application of NEC in construction projects in mainland were proposed from four aspects: thetransformation of cooperation concept， the selection of pilot projects， the language of the contract， and the configuration of teammembers. |
