本文结合中国有色金属建设股份有限公司在印度执行的两个对外工程总承包项目的实践经验,论述了中国公司在印度开展总承包项目时普遍都遇到的进度拖延、成本不可控等问题,分析了中国公司在印度市场执行项目时受阻的原因,提出了在执行印度总承包项目时应按照印度业主控制项目进度的模式,采取按照工程量和工程单价的计价方式来给合同定价、报价;项目签署后可以通过成立印度子公司的方式解决工作签证和进度拖延问题,以及在项目实施期间加强与印度业主和分包商的沟通等办法。 相似文献

This paper first analyzes the problem of default risk that contractors and owners often face in China, then stresses that establishing a construction contract guarantee system is a necessary and effective measure for solving this problem. Policy choice for establishing a construction contract guarantee system in China is presented in this paper by using the experience of developed countries for reference and taking Chinese domestic circumstances into account. Construction contract modules are delivered to second-year architectural technology and construction/construction management students undertaking foundation and undergraduate degree programs. Feedback and assessment results from recent years showed that students generally found these modules difficult. Studies were conducted to further understand students’ experiences and expectations, to assess quality of teaching, and to evaluate the dissemination of theoretical and practical knowledge during the delivery of construction contract modules. The objective was to review the methods used for teaching, learning, and assessment of construction contract modules and make recommendations to inform and improve future module development and delivery. This paper is based on a first-time experience of teaching a law-related subject to construction students. Reflection on the teaching and assessment methods implemented during the term and on student responses permits conclusions to be drawn on how best to improve students’ learning experience and simultaneously maintain the university’s quality standards. 相似文献

Within the bounds of the hospitalization contract and the department's work, the hospital management is liable for compensation for its own as well as its staff's culpable faults (liability of the accomplices) by contract and by offense. For the same damage, subordinate and senior physicians are liable by offense for malpractice and organization faults. To the outside, the hospital management and the medical staff are common debtors. To the inside, the hospital management bears the consequences by itself in case of a light negligence of a staff member, the damage is divided for medium negligence, and the staff member has to bear it alone after severe negligence. Beside the hospital, the physician with an authorization for billing is the contract partner of the patient with private treatment (physician side-contract). In a general practitioner hospital, the contract partner of the patient is only the general practitioner (divided hospitalization contract) and for work with outside-patients as a sideline the physician with an authorization for billing. Usually, the hospital management insures itself and all staff members for claims on compensation occurring during hospital tasks. 相似文献

This article describes the process of unionization for a group of public-sector psychologists. After administrative changes in the Circuit Court of Cook County's Forensic Clinical Services increased interest in unionization, the psychologists chose a union to represent them, identified contract goals and a negotiation strategy, and organized a contract campaign to pressure management for concessions. Since unionization, the psychologists have made significant movement toward achieving some of the contract goals, especially with the initiation of the contract campaign. The psychologists also faced and addressed problems related to the size of the bargaining unit, some fears and anxieties among the members, and the slow pace of negotiations. Their experience illustrates how collective efforts, such as involvement in organized labor, can lead to more professional working conditions for psychologists and to better quality care for the public.
