旅游土地征收的公益性分析

公益性是土地征收的唯一合法理由。随着土地征收研究的日益深入,旅游土地征收的合法性已备受争议。本文据已有的研究成果总结出土地征收公益性的判断标准,并认为旅游土地征收是现阶段我国可持续发展的需要,具有一定的公益性。

An Analysis of Tourist Land Expropriation in Terms of Public Welfare

Commonweal is the only legal cause for land expropriation.Whether a tourist land acquisition is legitimate or not has become a controversial issue with the advance of research in this field.This paper,based on a review of previous studies,comes up with criteria for judging the legitimacy of land expropriation,arguing that tourist land expropriation,consistent with the sustainable development strategy of our country,is beneficial for public interests.
