| 摘 要： | 商业性地勘成果,由于人身权和财产权的二元化分离,在价值利用方面又负载多项财产权利。多元化的投资主体引发利益冲突。应对知识产权法律制度和矿产资源法进行修正和增加,使商业性地勘成果知识财产和相关权益达到利益平衡。

| Abstract: | As a result of dual separations between the Personal Rights and the Property Rights,commercial geological prospecting achievement rights have many properties rights in the value aspect.Multiplex investment body initiates benefit conflicts.More should be carried on the revision and the increase to the Intellectual Property Rights Law System and Minerals Resource Law,which can balance the interests between commercial geological prospecting achievement rights and its relating rights. |
