反倾销司法审查标准之比较研究

反倾销案件的司法审查标准,是指法院对被反倾销行政行为审查的范围和程度。审查标准是审理反倾销案件的核心问题,因为它直接关系到人民法院对反倾销行为的介入程度。由于反倾销案件的技术性和专业性较强,并且和国家的外贸政策有直接关系。因此,各国的反倾销司法审查的标准也不同。本文拟在对反倾销案件的司法审查标准进行比较研究的基础上,对完善我国的反倾销司法审查制度提出建议。

Comparative Study on Standards of Judicial Review of Anti-dumping Cases

The standard of the judicial review of anti-dumping cases is linked with the court's review on the range and degree of the appealed anti-dumping administrative behaviors.The standard of review is the key problem of the anti-dumping cases,which is directly related to the degree and depth how the court intervenes in the anti-dumping behaviors.Due to the high technical and professional demand of anti-dumping cases and the direct relationship to the state's foreign trade policy,the review standards of different countries are very different.This paper tries to make a comparative study on the standards of the judicial review of anti-dumping cases of different countries and on this basis puts forward some points to improve our system of the judicial review of anti-dumping cases.
