论注册商标的使用及其对商标专用权法律效力的影响

商标经过注册以后，商标注册人所面临的一个重要问题就是如何有效地维持注册商标专用权的效力。根据法律规定，影响注册商标专用权效力的因素有两个：一是商标注册人对商标的使用行为；二是在注册商标一次有效期届满时，注册人是否及时办理续展手续。实践中人们普遍重视第二个因素而忽视第一个因素。针对这种状况，本文着重阐述了商标使用、不使用、不适当使用的认定标准，并对上述行为的法律后果进行了探讨。

Use of Registered Trade Mark and Its Influence on Legal Effects of Specialized Power of Trade Mark

After the trade mark was registered, the critical problem that the registerer faces is how to effectively maintain the legal effects of the specialized power of the trade mark. According to corresponding laws, there are two factors influencing the effects of the specialized power:the behaviours of the registerer in using the trade mark and the timely extension of the effective period before it expires. In practice, more importance is attached to the second factor rather than the first. In view of this, this paper states the identification standards of appropriate and inappropriate applications and non - application of trade marks, and discusses the corresponding legal consequences arising from these behaviours.
