论西方法的精神

法的精神支配着对社会经济、政治、文化进行的法律性制度安排,法的精神是一种存在于所有法律当中的价值观念,它来源于对正义的不断追求。渊源于古希腊哲学的正义观是西方法律制度内在的根本观念,它启示和支配着根植于西方文明的法律制度的产生和发展。有着时代特点的并非完全一致的每一时代的一定正义观念都从社会观念的角度引导着法的发展,制约着法的发展,体现在法的制度之中,成为法发展变化的灵魂和精神。
