民办高等院校法人治理外部机制研究

以湖南省民办高等院校为例，对民办高等院校的治理结构进行剖析，目前民办高等院校外部治理呈现发展不均衡性、办学机 制准市场化和管理非规范化。因此，创新民办高等院校法人治理外部机制，充分发挥党组织负责人和督导专员作用，构建政府参与 高等院校外部治理机制，健全国家公共财政对民办教育扶持政策体系，完善和创新民办高等教育中介组织，大学生家庭以委托人 身份参与大学治理。完善民办高等院校法人治理外部机制，从而实现民办高等院校的有效治理。

On the External Corporate Governance Mechanism of Private Colleges and Universities

Taking private colleges and universities in Hunan province for example, this paper analyzes the governance structure of private colleges and universities. Currently, such problems as the imbalance of development, the school-running mechanism in quasi marketization and the irregular management exist in the external corporate governance mechanism of private colleges and universities. Private colleges and universities should innovate the external corporate governance mechanism, give full play to the role of the person who is in charge of the Party organizations and the role of the person who is assigned specially for supervision and guidance,construct an external governance mechanism of private colleges and universities in which governments can participate, complete the policy system for national public finance to support private colleges and universities, perfect and innovate the intermediary organizations which are oriented towards private higher education, and permit family members of the college students of private colleges and universities to join in university governance as a client. In short, only when the external corporate governance mechanism of private colleges and universities is really perfected can private institutions of higher learning be governed effectively.
