论消防责任事故罪客观要件的设立缺陷及弥补

对我国《刑法》消防责任事故罪客观要件的设立缺陷，从法理的角度对消防监督机构实施消防监督检查的范围、形式和重点进行了论证，并从我国消防安全的形势，以及我国加入WTO后消防监督管理模式的改变，迫切需要刑事法律加大对违反消防管理行政法规造成重、特大火灾事故责任人的打击力度，提出了对消防事故责任罪客观要件重新设立的构想。
