| 摘 要： | 第三人利益合同是在开放经济条件下，合同当事人意思自治的产物，有利于保护第三人的利益，实现成本节约，但在合同相对性原则下是不能顺利实现的。分析了第三人利益合同存在的基础，探讨了第三人利益合同的效力，进而提出第三人利益合同的立法建议。

| Abstract: | The contract for the benefit to third party is a result with contract party intention . It contributes to protecting the benefits to the third party and realizing cost economy, but it can' t be achieved smoothly under the relative principles. The paper analyses the existing base of contract for the benefit to the third party, discusses the efficacy of it , and at last, provides contract legislation for benefit to the third party. |
