| 摘 要： | "小产权房"中存在的利益主体及利益关系是"小产权房"存在的现实逻辑.运用制度经济学方法,深入剖析我国现行的土地制度、产权结构和资源配置情况,或许可为"小产权房"寻找到理论上的逻辑."小产权房"的出现,是对现有土地制度的挑战,集中反映了农村利益团体对利益的诉求.未来土地制度变革的不确定性,导致空间规划的有效性和合理性受到置疑.解决现实问题需进行一系列的配套制度改革.

| Abstract: | The phenomenon of limited property house is caused by multi benefit subjects and their relationship in rural areas. Institutional economics approach can be applied to analyze the background land system, property-right structure, and resource configuration. Limited property house is a challenge to current land system and represents rural groups' request for their rights.
