生态红线划定中的矿业权处置问题初探

中共中央办公厅、国务院办公厅《关于划定并严守生态保护红线的若干意见》要求,到2020年底前,全面完成全国生态保护红线划定,勘界定标。这将对我国矿产资源勘查开发及管理格局产生巨大而深远的影响。当前,各地在各类保护区内的矿业权退出方面遇到了重叠面积不清、规划协调不足、遗留问题突出、勘查开采空间被大幅挤压等问题,这些问题在生态红线全面划定过程中将进一步凸显,亟待从顶层设计的角度,作出系统的制度安排。事实上,《生态保护红线划定技术指南》早已确定了"合理性、协调性、可行性"原则,提出要生态红线划定要"适应经济社会发展需求和当前监管能力,预留适当的发展空间和环境容量空间"。对此,本文从加强矿产资源勘查开发管理的角度,提出要提前对接、主动服务,尽快摸清重叠底数、加强规划协调、分级分类处置、探索建立储备机制,确保生态红线"划得实、管得住"。
