| 摘 要： | 社会募捐是特殊形式的捐助。社会募捐指为特定的自然人的利益而发起,并通过募集人与捐赠人之间的募捐合同实现的捐助行为。从法律解释学的角度分析,社会募捐应认定为以募集人和捐赠人为合同当事人以受益人为第三人的第三人利益合同,而不是代理、信托。捐款纠纷应依据第三人利益合同进行解决。

| Abstract: | Communal solicit contribution refers to a special donation conducted for the interest of a specific natural person and realized through the contract between collector and donator.Expounded legally,such contribution shall be regarded as the third-party interest contract with the collector and the donator as the contract party and the beneficiary as the third party instead of the agent or the trust.Thus,the dispute arising shall be solved in the light of third-person interest contract. |
