| 摘 要： | 围绕非法吸收公众存款罪的犯罪对象、主体、客体等方面进行讨论。就非法吸收公众存款罪在实践中存在的一些疑难问题，如行为人非法吸收存款但被害人不认为自己被害，金融机构高息揽储，以存代借行为是否构成犯罪等进行研究。

| Abstract: | The objet, subject and objective parts of the crime of illeagally sucking in public deposits were discussed. The difficult problems in recognizance of the crime in practice are studied, such as in condition that the victims don＇t realize the crime is done and in condition that the finance institutions draw the deposites with higher rates and the legality of the behavior of saving under mask of borrowing. |
