| 摘 要： | 美国住房市场的法律和制度框架建立于"新政"时期,它经历了20世纪70年代的金融和房地产业去管制化改革。以资产证券化和金融衍生交易为主要形式的房地产金融创新突破了既有法律与监管框架,次贷过程中充斥着信息披露不实、掠夺性借贷、会计违规甚至刑事犯罪等违法、违规现象。改革法律、强化监管、深化制度间的协调的整体性治理方案是治理此次危机的应然思维方式和必要手段。
