国际性组织及美英等国金融衍生交易监管述评

金融衍生交易自20世纪70年代中期产生以来,国际性经济金融组织以及美英等主要国际金融中心所在国家或地区都高度重视对其监管,但由于国际性组织的法律效能及各国监管当局的监管理念、监管模式等差异,使得最终的监管效果迥异。本文通过述评近三十年来国际社会对金融衍生交易监管中推出的七大成功举措和存在的五个问题,归纳出构建合理有效的监管体系、提高对衍生性交易的资本充足率要求、采用"先立法,后开办"模式、强化内部管理、加强对监管者的监管等七个方面的启示,以期改进和完善中国的金融衍生交易监管,促使金融衍生交易在中国的正常发展。
