独立学院的法律地位探析

在我国探索多种办学模式的过程中,独立学院是依托高校的社会声誉、教育资源等无形资产,按民办机制运行的一种新的办学模式。在实施过程中,独立学院存在许多问题,而法律地位的确立对于其生存和发展非常重要。本文从教育法学的角度,通过分析独立学院与政府、社会、投资方、所依托的高校以及它与教师、学生的法律关系,来探讨独立学院的法律地位。同时,针对目前确立独立学院法律地位的现实问题,提出了一些合理化建议。

On the Legal Status of the Subordinate College of the Chinese University

In the course of exploring various models were explored in China, the subordinate college is a new one which depends on the intangibles of the university or college, such as reputation and resources, and is run like the private college. In the practice, there arose some problems, among which the uncertainty of its legal status is very evident. From the perspective of educational law, this paper analyses the external relationship between the subordinate college , government, society, investors and the university on which it is dependent, and explores the internal relationship between the subordinate college and the faculty, and students.At last,some suggestions were put forward.
