| 摘 要： | 商品房预售制度具有法律上的不平等性和经济上的垄断性,其负面效应日益受到人们的关注,2005年人民银行甚至提出取消商品房预售的建议。笔者从完善商品房制度的目的出发,对商品房预售制度中的相关问题进行了探讨。

Consideration on the Preselling System of Commercial Housing |

| Abstract: | The preselling system of the commercial housing has the characters of unfairness in the terms of law and makes an actual monopoly in terms of economics, therefore there are more and more people pay attention to the disadvantages of it, and even the People's Bank suggested to cancel it in the year of 2005. This paper discusses some questions about the preselling system of the commercial housing from the angle of optimizing it. |
