| 摘 要： | 通过文献分析将逾期竣工违约金的确定问题分解为违约金的约定和约定过高情况下的调整两个方面;分析发包人在约定逾期竣工违约金时应考虑的因素及约定的两种方式,具体研究不同方式下违约金金额的确定。最后,通过整理相关法律文件明确约定过高情况下逾期竣工违约金调整的两个基本原则,并据此将逾期竣工违约金的调整分为实际损失可计量与不可计量两种情况并作具体考虑。

Research on the Determination of Penalty for Overdue Completion under the Construction Contract(2013) |

| Abstract: | Firstly,the paper decomposes the determination of penalty for overdue completion into two aspects about engagement and adjustment of default penalty. Secondly,analyzes the various factors of engagement,and through analysis of engineering contracts,gets two common ways of engagement and studies the determination of the amount of default penalty in different ways. Lastly,establishes two basic principles of adjustment through legal documents analysis,and divides adjustment into two cases according to whether the loss can be measured based on two principles. |
