Online Arbitration has increasingly become a popular method for the resolution of electronic commerce disputes due to its inexpensive, speedy, and global nature. However, this kind of arbitration may face many consumer and doctrinal problems that threaten the legal validity of its procedures in the digital world. This paper thus aims to explore whether or not there are any legal obstacles to the use of online arbitration or to the recognition and enforcement of online arbitral awards within the current legal framework in the United Arab Emirates. As such, this paper briefly discusses whether the formal requirements of validity are satisfied if the arbitration agreement is entered into electronically or if the arbitration proceedings are handled from start to finish in a computerized manner. Furthermore, this paper addresses whether or not there is any need to set up specific sets of rules for online arbitration.  相似文献

Arbitration is a preferred method for the resolution of international business disputes. As of yet, most publications on online arbitration deal with legal issues. In this paper, we present an Online arbitration environment that we believe facilitates the participants in a meaningful way. Our assumption is that an ODR service should be easy to use (convenient), and at the same time provide meaningful support. More specifically we have paid attention to four criteria that we believe are important, viz. simplicity, awareness, orientation and timeliness. In this paper, an initial theory of online learning as online participation is suggested. It is argued that online learner participation (1) is a complex process of taking part and maintaining relations with others, (2) is supported by physical and psychological tools, (3) is not synonymous with talking or writing, and (4) is supported by all kinds of engaging activities. Participation and learning are argued to be inseparable and jointly constituting. The implication of the theory is straightforward: If we want to enhance online learning, we need to enhance online learner participation.  相似文献

This study investigates the antecedents of customer satisfaction with online banking in China, and explores the effects of experience on the relationships between the antecedents and customer satisfaction. Based on prior research, the six antecedents of customer satisfaction – ease of use, design, speed, security, information content and customer support service – are proposed, and the effects of experience on the relationships between these and customer satisfaction are analyzed using a structural multi-group (a high-experience group and a low-experience group) model.  相似文献

We sought to gain understanding of voluntary developers’ involvement in open source software (OSS) projects. Data were collected from voluntary developers working on open source projects. Our findings indicated that a voluntary developer's involvement was very important to his or her performance and that involvement was dependent on individual motivations (personal software needs, reputation and skills gaining expectation, enjoyment in open source coding) and project community factors (leadership effectiveness, interpersonal relationship, community ideology). Our work contributes theoretically and empirically to the body of OSS research and has practical implications for OSS project management.  相似文献

ContextOpen source development allows a large number of people to reuse and contribute source code to the community. Social networking features open opportunities for information discovery, social collaborations, and improved recommendations of potential collaborators.ObjectiveOnline community and development platforms rely on social network features to increase awareness and attention among community members for improved collaborations. The objective of this work is to introduce an approach for recommending relevant users to follow. Follower networks provide means for informal information propagation. The efficiency and effectiveness of such information flows is impacted by the network structure. Here, we aim to understand the resilience of networks against random or strategic node removal.MethodSocial network features of online software development communities present a new opportunity to enhance online collaboration. Our approach is based on the automatic analysis of user behavior and network structure. The proposed ‘who to follow’ recommendation algorithm can be parametrized for specific contexts. Link-analysis techniques such as PageRank/HITS provide the basis for a novel ‘who to follow’ recommendation model.ResultsWe tested the approach using a GitHub-based dataset. Currently, users follow popular community members to get updates regarding their activities instead of maintaining personal relations. Thus, social network features require further improvements to increase reciprocity. The application of our ‘who to follow’ recommendation model using the GitHub dataset shows excellent results with respect to context-sensitive following recommendations. The sensitivity of GitHub’s follower network to random node removal is comparable with other social networks but more sensitive to follower authority based node removal.ConclusionLink-based algorithm can be used for context-sensitive ‘who to follow’ recommendations. GitHub is highly sensitive to authority based node removal. Information flow established through follower relations will be strongly impacted if many authorities are removed from the network. This underpins the importance of ‘central’ users and the validity of focusing the ‘who to follow’ recommendations on those users.  相似文献

This essay describes the development of an ESL OWL by grounding practices in language and literacy pedagogy theory. An initial discussion explores OWLs emulating physical writing center spaces. Two areas of concern are then addressed in meeting the needs of second language writers as they relate to practices and training for online tutoring: error correction—an area of frequent concern to second language writers—and increased interactivity—meeting second language writer expectations and creating autonomous learners. Issues of plagiarism by second language writers are discussed as related to the type of feedback OWL tutors can provide. Highlighted throughout are samples of interactions between tutors and writers that show a process of learning how to create dialogue rather than dictations from the tutor to clean up a single essay.  相似文献

Social networks are increasingly becoming important due to many aspects of everyday life supported and being facilitated through on-line activity. Billions of individuals are enjoying the use of social networks today and, therefore, they are becoming an important innovation in the modern world. However, due to disputes and concerns that are associated with such activities, the social networking world has yet to reach its full potential. When disputes occur in the on-line world, measures need be taken to settle those disputes in the same way that they were created. Through solving these disputes, the social networking world will be assisted in reaching full potential. One way of settling user disputes in the social networking world is the use of online arbitration. There are a number of advantages to using online arbitration as the parties involved will only communicate through the Internet and do not need to travel throughout the process. This helps in lowering the litigation costs to all parties involved. Considering the advantages online, arbitration has and the power that the social networking world bares, it is possible for users' disputes to be resolved and encourage communication between masses of users to build their confidence. With confidence that their disputes can be resolved easily, more users will be willing to publicise their profile for other users to view.  相似文献

This paper draws on three years of data from an online course on educational technology for practicing teachers, in which a goal was for teachers to develop a web-based application they could use in their own teaching. Based on analyses of discussion forums and teachers' course projects, we found that iterations of the course evolved over the years from being a loose association of peers involved in vastly different development projects with different tools, to a community of designers involved in a common endeavor, as more and more students chose the same open-source learning management system for their course projects. We tracked what factors seemed to affect how many and which teachers chose which development technologies, and how the process of making these choices evolved with the increased role of designed and emergent forms of peer modeling. We situate these findings in the literature on teacher professional development and technology use, arguing that existing conversations need to attend to the important role that peers play in teachers' learning and innovation adoption, particularly in online learning environments.  相似文献

Trust and perceived risk have been identified as the two primary factors affecting engagement in online transactions. However, earlier studies have conceptualized the directionality of the causal link between these two factors differently. Some researchers have conceptualized trust as an antecedent to risk, while others see it as a consequence. To resolve this issue, we develop a bidirectional model in which trust and perceived risk mutually influence each other. We then test the ability of the bidirectional model to provide a more realistic explanation of buyers' decision-making than previously offered unidirectional models. In a sample of 747 experienced buyers in the online marketplace, we find a reciprocal and nearly equal effect of trust and perceived risk. The results of the study reveal that the direct effect of trust on transaction intention is highly significant, whereas that of perceived risk is insignificant. Based on these empirical findings, we discuss the implications of our research, including the appropriateness of our research question and several paradoxes identified in prior studies.  相似文献

The current study utilized regulatory focus theory to explain how online deliberations are processed differently depending on a participant’s information processing style and the characteristics of a discussion topic. An experiment was conducted to investigate the relationship between informational characteristics (hedonic vs. utilitarian) and attitude change toward information, as well as the moderating effect of regulatory focus (promotion vs. prevention). Results from 207 students indicated that promotion-focused participants were more likely to change their attitude toward information than prevention-focused participants during online deliberations. Furthermore, when presented with hedonic information, attitude changes toward information were stronger for promotion-focused participants as compared to prevention-focused participants. However, when presented with utilitarian information, attitude changes were stronger for prevention-focused participants. The present findings enable researchers and practitioners to understand the interactive influence of informational characteristics and regulatory foci of participants during online deliberations, as well as influence participants’ biased information processing.  相似文献

This study extends a stimulus–organism–response (S–O–R) model to include impulse-buying behavior, which plays a vital role in electronic shopping but has not gained much attention in e-commerce research. Grounding our research in environmental psychology, we test the effects of virtual atmospheric cues on online impulse-buying behavior and spending, via a consumer survey. The study applies elaborated mediating variables (shopping enjoyment and impulsiveness) to develop a structural model linking three categories of atmospheric cues of an electronic store (content, design, and navigation) to approach behavior variables (impulse-buying behavior and expenditure). The results support the validity of the S–O–R model in the context of online impulse-buying behavior and show a significant positive effect of two dimensions of virtual atmospheric cues (design and navigation).  相似文献

The popularity of online social networks has created massive social communication among their users and this leads to a huge amount of user-generated communication data. In recent years, Cyberbullying has grown into a major problem with the growth of online communication and social media. Cyberbullying has been recognized recently as a serious national health issue among online social network users and developing an efficient detection model holds tremendous practical significance. In this paper, we have proposed set of unique features derived from Twitter; network, activity, user, and tweet content, based on these feature, we developed a supervised machine learning solution for detecting cyberbullying in the Twitter. An evaluation demonstrates that our developed detection model based on our proposed features, achieved results with an area under the receiver-operating characteristic curve of 0.943 and an f-measure of 0.936. These results indicate that the proposed model based on these features provides a feasible solution to detecting Cyberbullying in online communication environments. Finally, we compare result obtained using our proposed features with the result obtained from two baseline features. The comparison outcomes show the significance of the proposed features.  相似文献

Social presence in online learning environments refers to the degree to which a learner feels personally connected with other students and the instructor in an online learning community. Based on a 19 item Online Social Presence Questionnaire (OSPQ) given to college students in two different online learning courses, a series of exploratory and confirmatory factor analyses consistently revealed five factors representing facets of social presence in online learning environments: social respect (e.g. receiving timely responses), social sharing (e.g., sharing information or expressing beliefs), open mind (e.g., expressing agreement or receiving positive feedback), social identity (e.g., being called by name), and intimacy (e.g., sharing personal experiences). Together, the five factors accounted for 58% of the variance and were based on 19 items. Although much previous research focuses on cognitive aspects of learning in online environments, understanding the role of the learner’s sense of presence may be particularly important in distance learning situations in which students and the instructor are physically separated.  相似文献

Continued and frequent use of social network sites (SNS) has been linked to a fear of missing out (FOMO) and online self-promotion in the form of friending and information disclosure. The present paper reports findings from 506 UK based Facebook users (53% male) who responded to an extensive online survey about their SNS behaviours and online vulnerability. Structural equation modelling (SEM) suggests that FOMO mediates the relationship between increased SNS use and decreased self-esteem. Self-promoting SNS behaviours provide more complex mediated associations. Longitudinal support (N = 175) is provided for the notion that decreased self-esteem might motivate a potentially detrimental cycle of FOMO-inspired online SNS use. The research considers the implications of social networking on an individual's online vulnerability.  相似文献
