互联网在给人们工作、生活带来快捷便利的同时,也能产生巨大的负面效应。为维护互联网健康有序和谐稳定发展局面,必须加强对互联网的依法管控。目前,我国针对互联网管控出台了一系列法律法规,多个管理部门也在依法履行管控职能,但在管控过程中还存在诸多问题,实际管控效果不尽人意。在当前互联网发展新形势下,需要分析借鉴国外先进的管控经验,从法律制订、法律遵循、法律实施等多方面去进一步健全完善我国互联网管控法律体系。  相似文献

In Japanese schools, from elementary to college levels, digital technologies are not widely used for writing education. It sounds paradoxical that computer use in writing education is not flourishing in a country where ordinary people, especially the youth, actively use the Internet and cellular phones to exchange written (or typed) messages, where schools are well-equipped with computer technologies, and where the government shows guidelines and rationales for using information and communication technologies in teaching and learning at schools. This article analyzes the background behind this paradoxical situation. After analyzing how much research on and the practice of digital writing education has been made in the country, this paper discusses the nature of writing education and digital discourse in the Japanese culture and its possible relations to the lack of computerized writing education in Japanese schools.  相似文献

Writing teachers have always had to contend with plagiarism. However, the technology of the Internet and the thorny issues of copyright law complicate how we teach legal and ethical use of others’ materials in the networked classroom. Our pedagogy and curriculum choices and our students’ writing practices are shaped by a legal infrastructure that includes the fair use doctrine. Our understanding and knowledge of the fair use doctrine should become second nature to us. Critical awareness of fair use, the four-factor test, and how to conduct appropriate analyses when using others’ materials must become part of the everyday digital writing/new media classroom curriculum. To this end, the author summarizes the salient points of law and practice of fair use and demonstrates, in small ways, how the fair use doctrine can inform the teaching of writing in digital contexts. As teachers, researchers, and experts of writing, the discourse of fair use must be considered in addition to the discourse of plagiarism.  相似文献

This article raises questions about the evaluation process for composition faculty who use computer and Internet technologies in the classroom, and for distance learning. In particular, I discuss the panoptic effect made possible by the accessibility of our class Web pages to administrators, and provide an example situation from which we might learn. At Western State University College of Law, one of the nation's largest law schools, students are using computers to reduce the time-consuming process of legal research–sometimes by as much as 75%, according to WSU's Dean Ross Lipsker. Once high schools are connected to the Internet, teachers are the key to the successful use of the Internet for both teaching and learning. Teacher anxiety, however, can often reduce the success of such technological and pedagogical innovations. The purpose of this study was to explore the Internet anxiety experience by Taiwan high school and vocational high school teachers. This study reviewed related literature in computer anxiety and discussed the further development of the Internet Anxiety Scale (IAS), which was used to survey 136 teachers in Taiwan. The statistical data produced by this study identified four aspects of Internet anxiety: Internet use, hardware construction, management of students' Internet-use, and learning computer-related skills and knowledge. Among these, survey respondents ranked anxiety over managing students' Internet-use as the highest problem. Further, results indicated that female teachers had significantly higher Internet anxiety than did male teachers, and teachers' majors or subject areas appeared to contribute significantly to the level of Internet anxiety as well. Results also showed that both computer-use hours per week and Internet-use hours per week were significantly negative factors when correlated with anxiety over Internet uses, hardware construction, and management of students' Internet-use.  相似文献

In recent years, institutions of higher learning and research and the libraries that support them have become increasingly concerned about the costs and conditions of the publication and distribution of scholarship. In response, several universities have begin to explore the possibility of their libraries functioning as publishers, particularly looking to explore the possibilities and costs of electronic publication. The University of Michigan Library's Scholarly Publishing Office(l) (SPO) is one such institutional venue for the electronic publication and distribution of scholarly content. This discussion summarizes some of the policy issues that led to the creation of SPO, and describes SPO's organisation and some of the activities that instantiate its mission of building sustainable publication models that bridge the gap between academic self‐publishing and large, aggregated, commercial publishing. It also raises several questions about how libraries should function as publishers, and about cooperation and collaboration in building alternative venues for scholarly publishing. In detailing the work of SPO, the author hopes to use it as a case study to illuminate the mission of library‐based scholarly publishing efforts and the challenges such efforts must meet in order to succeed.  相似文献

Abstract A great deal has been written about the use of web-based technologies such as the Internet in promoting learning in education. In schools, research has focused primarily on social interaction and group work, student achievement levels and curriculum development. Very little study seems to have been brought to bear upon the promotion of creative thinking by the use of online technologies, and this paper attempts to contribute to this field of study. This paper reports on a pilot study which has investigated the creative impact of information and communication technology (ICT) in a rural primary school in South-west England. The school is unique because it provides a personal networked computer for each of its 41 Year 6 students (aged 10–11 years). A small group of students were interviewed about the learning activities they engaged in over the year, and this paper reports on initial findings with a special emphasis on creative working and thinking ( n  = 6). A model of creativity is presented with three discrete but related modes of activity — problem solving, creative cognition, and social interaction. The paper provides new findings about the nature of creativity in the context of computer based learning environments.  相似文献

The use of the computer in the legal arena has seen a rapid increase over the last decade ranging from the simple level where it is used to gain access to information to the complex level where it is used for diagnostic and decision making purposes. This second use of technology makes certain assumptions at the theoretical level regarding the nature of law and legal reasoning. This paper outlines in brief the jurisprudential assumptions made and the resulting questions raised as a consequence of the possiblity of ascribing legal functions to intelligent computer systems.  相似文献

This paper examines the use of connectionism (neural networks) in modelling legal reasoning. I discuss how the implementations of neural networks have failed to account for legal theoretical perspectives on adjudication. I criticise the use of neural networks in law, not because connectionism is inherently unsuitable in law, but rather because it has been done so poorly to date. The paper reviews a number of legal theories which provide a grounding for the use of neural networks in law. It then examines some implementations undertaken in law and criticises their legal theoretical naïvete. It then presents a lessons from the implementations which researchers must bear in mind if they wish to build neural networks which are justified by legal theories.  相似文献

This paper seeks to examine the nature and experiences of children's computer use in the home and school. Past research suggests a growing gap between computer use in the home and the school. This study was conducted to find out how children perceive and enjoy computer use in these two environments. Using a sample of year 3 and 5 pupils in three primary schools, qualitative and quantitative data were gathered. The results suggest that children make more use of the computer at home than at school. The most popular activity on the home computer which all children enjoyed was playing games. The most frequent activity at the school computer was word processing which pupils considered boring. Interesting gender differences showed that boys spent more time playing computer games whereas girls spent more time on the Internet emailing friends. The study concludes that schools should learn from what works at home and enable children to work on activities they find valuable, motivational and worthwhile.  相似文献

Written laws, records and legal materials form the very foundation of a democratic society. Lawmakers, legal scholars and everyday citizens alike need, and are entitled, to access the current and historic materials that comprise, explain, define, critique and contextualize their laws and legal institutions. The preservation of legal information in all formats is imperative. Thus far, the twenty-first century has witnessed unprecedented mass-scale acceptance and adoption of digital culture, which has resulted in an explosion in digital information. However, digitally born materials, especially those that are published directly and independently to the Web, are presently at an extremely high risk of permanent loss. Our legal heritage is no exception to this phenomenon, and efforts must be put forth to ensure that our current body of digital legal information is not lost. The authors explored the role of the United States law library community in the preservation of digital legal information. Through an online survey of state and academic law library directors, it was determined that those represented in the sample recognize that digitally born legal materials are at high risk for loss, yet their own digital preservation projects have primarily focused upon the preservation of digitized print materials, rather than digitally born materials. Digital preservation activities among surveyed libraries have been largely limited by a lack of funding, staffing and expertise; however, these barriers could be overcome by collaboration with other institutions, as well as participation in a large-scale regional or national digital preservation movement, which would allow for resource-sharing among participants. One such collaborative digital preservation program, the Chesapeake Project, is profiled in the article and explored as a collaborative effort that may be expanded upon or replicated by other institutions and libraries tackling the challenges of digital preservation.  相似文献

The Internet may be, as typically suggested, important in distance education for facilitating connections between groups of students, educational institutions, and external learning resources. This article, however, reveals why this is not the only reason for applying information and communication technologies (ICT) in higher education in a remote area in a developing country. In addition, the Internet seems to be of great importance in symbolizing modernization and progress, thereby adding symbolic power to such education. Empirical sources originate from an explorative case study of an Internet-supported distance education program in the province of Bangka Belitung in Indonesia. Based on a translation perspective on the spread of pheromones, the analyses of empirical sources show how the Internet has contributed to the spread of distance education, but paradoxically this has not had much effect on the use of Internet by students in peripheral areas, at least not in the short term. © 2008 Wiley Periodicals, Inc.  相似文献
