Med‐Arb Agreements since Thione: A Practice Update

In 2008, we published an article exploring the potential for federal courts to conclude that mediation and arbitration, or med‐arb, agreements did not qualify as “arbitration” under the Federal Arbitration Act. 9 U.S.C. § 2 (2011). Dealing with the One‐Hour SO2 NAAQS Implementation

In June 2010, the US Environmental Protection Agency (EPA) finalized a new, very stringent National Ambient Air Quality Standard (NAAQS) for sulfur dioxide¹ (SO₂).     

Lignosulfonates: effects on plant growth and survival and migration through the soil profile

The effects of Lignosite^#rm lignosulfonate, a refined lignosulfonate product that is obtained from the sulfite pulping process, on growth and survival of plants were investigated. Following applications of 0, 7500, 15,000 and 22,500 cm³#shm² to 32 plots within a forest plantation, the following were monitored: (1) live aboveground biomass of vascular plants, (2) growth of Douglar fir (Pseudotsuga menziesii) and (3) lignosulfonate migration through the soil profile. Live aboveground biomass of woody vegetation was not affected, and that of herbaceous plants was significantly decreased only at the two greatest application rates. Growth of the Douglas fir trees was not significantly affected. Lignosulfonates disappeared from the soil profile at the same rate regardless of initial concentration. Although it is not practical to use this material as a herbicide in western Washington, land application of lignosulfonates may be environmentally more attractive than traditional disposal methods.     

Distensible air accumulators as a means of adiabatic underwater compressed air energy storage

In the near future, the electricity industry is likely to face historically significant changes. The onset of distributed generation, micro and smart grids will change the entire structured industry. An influx of intermittent renewable generators will make traditional grid balancing notably more difficult. The novel concept of underwater compressed air energy storage is a potentially promising solution that may be used to meet these challenges, especially during the current period of electrical infrastructure renewal and modernisation. Early results from a Lake Ontario Pilot Study point to the potential viability of the concept.     

Geothermal energy in Australia

Although Australia is not usually associated with geothermal energy, it possesses significant amounts of both conventional (wet) geothermal and hot dry rock (HDR) geothermal resources. The country's conventional geothermal resources are extensive, but are low temperature and are located in areas of low population density with the result that they are not used extensively for either electricity generation or for direct heating. Australia's HDR resources, on the other hand, represent a world-class resource but have not been used to date because the technology for converting HDR resources into electricity is not yet fully commercial. The effort being directed towards exploring economically useful HDR resources and in the development of technology to convert this energy resource into electricity could make HDR resources an important part of Australia's energy mix in the near future, but there are major barriers.     

Engineering the Rural Idyll: Road Construction and the Peri-urban Landscape in Belgium, 1925–1940

As in many other Western countries, the road network in Belgium was subject to an extensive modernisation project during the interbellum period. This paper analyses how this project affected the relationship between the road and landscape. In the absence of a comprehensive landscape project for road construction from the government, other parties played an important role in defining the road's relation to the landscape. Through their publications, images and discourses, an idealised image of landscape—a rural idyll—became interwoven with the narrative of the modern road. We will first position this Belgian project vis-à-vis other road projects abroad, and describe why landscape was a non-issue for the Belgian government and its engineers. Subsequently, we will examine how other parties—the road association, the construction industry, urban planners and architects—appropriated fragments of landscape to frame or support their own projects.     

The propensity for employee participation by electrical and mechanical trades in the construction industry

Using the four input-output tables compiled in Turkey to date, the aim of this paper is to examine the construction sector's role in the Turkish economy and analyse its relationships with the other sectors of the national economy. Analysis results show that the share of construction in Gross National Product (GNP) and National Income (NI) tend to increase whereas the GNP share of manufacturing is relatively stable and that of services tend to increase after an abrupt decrease in 1985; backward linkage indicators and output multipliers, as well as forward linkage indicators and input multipliers of construction industry are stable; and finally, direct and total construction inputs from manufacturing show relative stability and those from services tend to increase in recent years. These findings point out the similarities between the Turkish construction industry and some advanced industrial countries (AICs) like Japan and Italy showing signs of growing ‘maturity’ of the Turkish economy.
