Substantive economic law in the context of patents creates industrial property rights and monopolies in almost all fields of technology, affecting considerably the economic and social well-being of the state and its people. The mass nationalisation of the international patents of the European Patent Office (EPO) has long raised serious questions about democratic control, in view of the reality that most of its patents are taken by large companies and corporations from a small number of states, mostly from outside the EU. The EU has recently expanded this system by creating a federal (unitary) patent framework consisting of the EPO and a new international court, the Unified Patent Court (UPC), that abolishes the already limited national control. But how can national control ever be totally abolished, especially in such an important social–economic context? And, can the EU exercise effective democratic control of the federal system that it has created? The observed constitutional asymmetries of a federal/unitary patent system that is created in the absence of a federation and is based on two non-EU bodies (EPO, UPC) no longer guarantee the democratic participatory rights of the people for whose benefit economic rules and property rights are justified, regulated and applied.  相似文献

Today, the world is moving towards sustainable and renewable energy resources. In order to ensure sustainable and steady power supply, thermal energy storage (TES) is playing a vital role. Most parts of the literature focus on different techniques and new energy storage materials. There is a scarcity of data on technological inventions in the form of patents to provide information to new researchers and investors before starting their new projects on TES. So this research work seeks to address this gap by concentrating on the patent analysis of various technologies with respect to their global publication trend in TES research field. The proposed research work also elaborates the technological evolution in domestic and industrial applications of TES. This analysis is carried out using patent database search tools IncoPat and Espacenet. Patent documents are retrieved between the time span ranging from 2006 to 2018. According to research findings, the number of published patents related to different TES technologies increase every year. China, the United States, Japan, and South Korea are categorized as main depositor countries. Moreover, technology-based applications and their inventing organizations from different countries are also ranked in current research work.  相似文献

This study proposed a methodology that integrate sociotechnical systems (STS) and media big data analysis using text mining for the new, real-time technology assessment (TA). The essential steps of this method are composed of data collection using a cultural map, analysis with trends and patents, and synthesis using media big data. By applying this methodology to artificial organs, first, we have shown that STS can be apply to biosocial technical systems beyond the sustainability transition. The result reveals that a media discourse structures, in which eight countries began to form socio-technical regimes around technologies with their respective strengths, in an objective way. Each technology corresponded to the vested interests in each country's socio-technical regimes. These discourse structures helped us to identify substitution, two types of transformation, and reconfiguration as transition pathways. More importantly, our analysis results have also shown that the methodology helps to overcome the anticipation dilemma, saving the time and resources required for TA. Our integrated methodology has achieved similar results by using 23% of the budget, 25% of the time, and 14% of the work hours used for official TA. Lastly, the “objectivity” and “agenda setting” of this methodology can provide a breakthrough in overcoming the control dilemma.  相似文献

World Patent Information (WPI) is the leading international academic peer reviewed journal in the field of patent information. The journal was launched in 1979 and celebrated its 40th anniversary in 2019. In recognition of this event, the aim of this work is to analyse the main actors, research themes and audiences of WPI. The analyses are based on the Scopus and Web of Science databases and include bibliographic coupling, co-citation and co-occurrence of author keywords. WPI is a boundary-spanning journal with authors from academia, industry and governmental organisations, such as patent authorities. This unique composition provides a prominent platform for knowledge transfer between academia and industry. In addition, WPI facilitates knowledge transfer between academia and industry, with research institutions citing contributions from authors affiliated to industry and patent offices. Furthermore, WPI not only crosses the boundaries between organisations (academia, industry and government), but also across disciplines, linking IP management, technology and innovation management, engineering, computer sciences, physical and natural sciences.  相似文献

Hops (Humulus lupulus) are used in brewing industries worldwide. Regarding hop-related intellectual property (IP), cultivars can be protected under Plant Breeders’ Rights and as plant patents (USA). Hop growing areas can be granted Protected Designation of Origin (PDO) or Protected Geographic Indication (PGI). Harvested and benefited hops can be traded as registered and trademarked products. We searched for registered cultivars in the top hop producing countries and Brazil to evaluate how IP protection is achieved in each IP modalities, considering territoriality and variety distinction. Botanic data is now being supplemented with chemical and agronomic data to further differentiate varieties.  相似文献

对于建造方法、建造逻辑、材料性能等问题的关注是把建造作为建筑设计在当下的最核心问题.以”建造”作为工具对国内建筑实践现在遭遇的普遍困境进行批判和回应。这一方式是在某种程度上重构国内普遍缺失的建筑学的现代(modern)观念[虽然并不一定产生现代主义建筑(modernist architecture)]。即把当代中国的批判性建筑实践(或者也可称为“实验建筑”)视为一个延迟的文化意识、态度和策略,从而通过把现代延伸.获得迎对当代图像消费和商业化现实的批判动力。本文尝试从材料、性能和意义上打开“物质性”话题的三个切面,分别是:a)幕墙-装饰-模糊;b)墙纸-图案-政策:C)塑料-塑性-专利。  相似文献
