| 摘 要： | 运用法经济学的分析进路，对市场规制的产生、运行以及市场规制法的产生等问题进行了分析，分别得出了市场规制产生并根植于市场经济的内在本质与固有矛盾之中，市场规制的运行以救济市场失灵为临界，以充分尊重市场机制的运行为前提，以及市场规制法产生的必要性。

| Abstract: | This article proceeded in the way of law from the angle of economic and analyzed the establishment, the running of marketing regulation, as well as the establishment of marketing regulation law. According to this, it concluded that the marketing regulation was rooted in the inherent essence and the inherent contravention of marketing economic. It also concluded that the running of marketing regulation was on the circle of relief of the market which was out of control and on the premise of fully respecting the marketing mechanism. Therefore, it focused on the necessity of the establishment of marketing regulation law. |
