| 摘 要： | 为改进外商投资企业外汇管理,外汇管理局实施了外商投资项目下资本金结汇银行代位监管。但在操作过程中出现银行代位监管职能行使难度大、结算方式延迟结汇时间、企业利用政策漏洞,逃避资本金结汇监管等问题。可以通过建立健全外汇管理政策法规、外汇管理局强化对银行代位监管工作的指导、银行自觉强化履职意识、通过提高银行外汇从业人员整体素质等措施解决上述问题。

| Abstract: | To improve the foreign exchange management for foreign investment enterprises, SAFE carried out banking supervision subrogation in capital settlement against foreign investment projects. However, in practice the problems, such as settlement mode - caused settlement time delay and policy loopholes used by enterprise to evade capital settlement regulation, make it difficult for banks to function well. All these problems could be solved by establishing and improving foreign exchange management policies and regulations~ strengthening su- pervision guidance of bank subrogation by SAFE, consciously strengthening banks%ense of duty, and improving the overall quality of bank employees in charge of exchange. |
