| 摘 要： | 为了解决工程拖欠款严重制约施工企业生存和发展的实际问题，从施工企业可制作性角度出发，对工程拖欠款的危害，产品原因进行了分析和研究，提出了用新合同法，风险转嫁等方法维护施工企业合法权益等行之有效的措施。

| Abstract: | The paper focuses on how to solve the practical problem in arrears with project payment, which seriously restricts construction enterprises from existence and development. In the views of constrction unit, the authors explain and analyse the dangers as well as the causes of arrears with project payment, also advance a new practical theory using the law of contract or removing risk so as to protect the right and profit of constrction enterprises. |
