| 摘 要： | 英美法系从契约内规定信赖利益赔偿 ,而大陆法系则纯由契约外法律关系规定信赖利益赔偿。本文对英美法系和大陆法系上的信赖利益赔偿进行了比较研究 ,对信赖利益、信赖利益赔偿的概念、适用范围等问题进行了分析探讨 ,并对信赖利益赔偿的范围进行了论述。

| Abstract: | Reliance interest compensation is regulated within the contract in common law, while in civil law it is directed by statue out of contract law. Through the comparison of reliance interest compensation between common law and civil law, this article researches and analyses the definition, applicable area and compensation scope of reliance interest. In the author's opinion, the scope of reliance interest compensation should depend upon concrete circumstances and not be restricted to the expectation interest. |
