论西方诚实信用原则对我国城乡规划实施的启示

本文简要介绍了西方诚实信用原则的起源和发展历程，探讨了该原则的思想价值，包括制度的稳定性和行政成本的降低，以及行政关系双方互信与和谐社会的构建等两个方面。并从理论、行政法以及城乡规划法等三个层面回顾了诚实信用原则在我国的发展。在此基础上，结合城乡规划实施中存在的实际问题，从规划公布、行政许可、行政合同、行政指导等四个方面，就制度层面如何借鉴诚实信用原则进行了探索。

The Enlightenment of the Western Principle of Good Faith on the Implementation of China＇s Urban Planning

This paper introduces the origin and developing process of western principles of good faith, valuing the idea which includes the stability of principle and reduction of administrative costs, as well as mutual trust of the relations between the two sides and formation of harmonious society. From the three levels of theory, administrative Act and Urban and Rural planning Act, the article reviews the development of the principle of good faith in China. On this basis, combined with the practical problems that exist in urban and rural planning and implementation, the writing discusses how to learn from the principles of good faith, from four aspects of plan announcement, administrative licensing, administrative contracts and administrative guidance.
