建筑师负责制中的责权利关系比较研究——以行业标准合同为线索

建筑师负责制的制度核心是赋予建筑师在工程建设上的“责权利”关系，即“负哪些责、有哪些权、获哪些利”。这个问题在国际上通行建筑师负责制国家实施的建筑师行业标准合同条款上可以有所体现，通过分析实行建筑师负责制最具代表性的美国、日本、英制新加坡等国的行业标准合同条款，对比建筑师在合同中的责任、权力和权益情况，探究其存在和实施的背后逻辑，可以间接为我国推行建筑师负责制提供一些有益的线索。

A comparative study on Relations of Responsibilities,Power and Interests in the Architect Responsibility System: A case study based on standard contracts

The core objective of the architect responsibility system is to give architects "rights and responsibilities" in project construction. It clarifies what responsibilities, rights and interests architects should undertake. This issue can be assessed by the terms of standard contracts with architects in countries who adopt the international architect responsibility system. In this study, responsibilities, power and interests of architects in contracts were compared by analyzing the standard contract terms in America, Japan, Britain and Singapore. Reasons for the existence and implementation of these responsibilities, power and interests were explored. Research conclusions provided some indirect beneficial clues for the implementation of the architect responsibility system in China.
