| 摘 要： | 为了将国际工程管理中惯用的方法和手段尽快应用到我国建筑工程领域，探讨了DAB(dispute
adjudication board)作为一种解决争端方式的运怍机制和作用，介绍了DAB的产生，并阐述了DAB是一种非法定授权的、非正式的机构这一重要性质，系统分析了DAB的运行机制和工作内容，并在此基础上总结出了DAB解决争端时具有公平和公正性、独立性、科学性、可接受性、程序性、节约费用和增加信任度等作用和特点．最后介绍了DAB在我国的应用情况，并且分析了我国没有广泛采用DAB的原因，提出了解决的对策．

Tentative Study on DAB's Function in Settling Dispute |

| Abstract: | order to apply the international convention and method to the construction engineering realm in China as soon as possible, the function and operation mechanism of the DAB as a way to settle dispute are discussed. At first, the authors briefly introduce the creation of DAB and elaborates the important character that the DAB is an informal organization without legal authorization. And then they analyze the nine operation mechanisms and four aspects of the content in DAB. Based on those efforts, nine characters and functions-impartial, independence, scientific, acceptability, procedure, economy, reliability, etc are summarized. At last this essay also introduces the application of DAB in China, analyzes the reason why DAB is not applied widely and accordingly puts forward the solution. |
