遗产资源所有与占有——从出让风景区开发经营权谈起

针对最近我国西部有些地区提出的出让自然文化遗产地（本文主要讨论风景名胜区，自然保护区森林公园）的开发经营权，从理论上分析自然文化遗产资源公有产权存在的生，指出：拥有开发经营权实际上拥有了遗产资源的使用权和占用权，这也是一种资源所有的形式。这不仅在实质上改变了遗产资源的公有产权，而且可以进一步形成分割遗产资源的利益主体。这种政策将对我国珍贵的自然文化遗产资源产生非常不利的影响。

Ownership versus Possession of the Natural and Cultural Heritage Resource: Some Discussions on Remising the Developing Right inside Nature Heritage Spot

This paper focuses on, firstly, necessity of pub- lic property right for the natural and cultural heritage re- source; secondly, what shonld be the nature of property right for natural and culture heritage resource, on what is matter of the separation. Actually, if one company or a person holds possession of heritage resource for a long time, it is equal to change the resource's ownership. Third- ly, currently it may be unreasonahle to separate use right from property right for heritage resource because there is not any regulation concem the resource controlled in China yet.
