工程监理职业责任保险在中国的实施

职业责任保险是一项"较具时代性"的保险.到了上个世纪60-70年代,职业责任保险才开始在西方国家走向成熟和完善.目前,随着我国市场经济体制的发展以及大规模建设的进行,建设监理的任务和责任日益增加,由此产生的纠纷也逐渐增多,其中多数牵涉到了监理单位的职业责任问题,对于工程监理职业责任险的研究也因此亟待进行.本文在工程风险及职业责任保险的相关理论的基础上,重点研究了实施监理职业保险的必要条件,包括在法律法规上为监理单位对职业过失进行全额赔偿提供依据、将监理职业责任保险作为监理从业资质等级评定的重要标准、工程监理委托合同的修订以及监理职业责任保险标准合同的制定.最后,本文提出了在我国实施监理职业责任保险的建议,并讨论了工程监理职业责任险的实施对我国建筑业发展的影响.

Implementation of Professional liability insurance for Engineers in China

Professional liability insurance is "an insurance of modem style". In recent years, with the increase of large construction projects in China and engineers' duties, disputes increase accordingly, most of which are related to professional liability for Engineers. Based on the related theory of risk and professional liability insurance, this paper emphasizes on the necessary conditions to perform the liability insurance for engineers, including the modification of related laws and regulations, the standards to rank a consultant company and the contract between the owner and the en gineer, and the reversion of sample insurance contract. Suggestions on performing professional liability insur ance for engineers in China are presented. The influence of professional liability for Engineers on the devel opment of Chinese construction industry is also discussed.
