我国油气矿业权使用费制度改革的几点思考

我国实行矿业权有偿取得的制度。自1998年《矿产资源勘查区块登记管理办法》《矿产资源开采登记管理办法》规定了矿业权使用费标准和缴纳方式以来,油气矿业权使用费制度一直未发生变化。2017年国务院印发《矿产资源权益金制度改革方案》中提到了将使用费整合为占用费。本文通过梳理我国油气矿业权使用费的收缴现状,分析目前我国油气矿业权使用费制度存在的问题,在此基础上提出了我国油气矿业权占用费制度改革的政策建议。

s: The compensated acquisition system of mining rights is implemented in our country. The royalty system of oil and gas mining rights has not been changed since 1998, when the standards and payment modes of royalty for mining rights are stipulated by the measures for the registration and administration of mineral resources exploration blocks and mineral resources exploitation. In 2017, the state council issued the reform plan of mineral resources equity fund system, which mentioned the integration of royalties into occupation fees. Through sorting out the current situation of the royalty collection for oil and gas mining rights in China, this paper analyzes the existing problems of the royalty system for oil and gas mining rights, and puts forward some policy suggestions on the reform of the royalty system for oil and gas mining rights in China.
