城市规划行政救济制度探讨

分析了城市规划行政行为区别于其他行政行为的特征,认为在城市规划行政中应该树立事前救济理念。指出城市规划行政事前救济的途径有:公众参与城市规划编制;对城市规划成果举行审批前听证;对批准的城市规划文件(尤其是详细规划文件)、决定等提请行政复议和行政诉讼,并将行政救济程序纳入城市规划行政编制、审查批准、变更和实施的全过程之中。最后,试图建立城市规划行政过程与行政救济程序的关系框架。

URBAN PLANNING ADMINISTRATIVE RELIEF SYSTEM

This paper analyzes the characteris-tics of urban planning administrative action. It pro-poses developing an ideology of relief-in-advance inthe administration of urban planning. The approachesof relief includes pubic participation in urban planning,holding evidence hearing of planning results beforethe examination and approval process, submitting theapproved urban planning documents (especially de-tailed plan ) to administrative reconsideration and suit.And the procedure of administrative relief shall beincluded in the course of formulation, examination,alteration and implementation of urban planningadministration. Then it gives a relationship frame-work between the administration process of urbanplanning and administrative relief.
