| 摘 要： | 通过案例和理论分析，认为在项目法施工模式下，建筑工程项目经理部不具有独立的法律主体资格，并通过项目经理部法律地位的阐释，分析了项目经理部组建和运行过程中的几种不规范方式，并提出为了降低建筑施工企业在建筑工程中的经营风险，项目经理部在组建与运行中必须规范操作，严格遵守经企业授权和以企业的名义行为两个原则。

| Abstract: | Through the analysis of casuses and theories author think that the department of construction manager did not has independent legal subject status. And through the analysis on the legal status of the department of construction manager some disorderly conducts in the organization and operation of the department are analyzed. In order to reduce the operation risk of construction enterprises in construction engineering the department's operation should be standardization. Some principles should be bided by as1. Authorized by enterprise 2. using enterprise name. |
