论法律翻译中的文化性表现——以《香港基本法》的英语译本为例

文章通过对《香港基本法》英语译本的批判性分析，从定性分析的角度探索了可能影响该法律翻译决策的理论和背景因素，得出的结论是法律翻译与文化休戚相关，在翻译过程中优先考虑的应该是源文的立法本意以及译文的法律效果，而非语义。因此，当译者在做语言方面的决定时虽然显得要比做法律方面的决定时自由得多，但是其文化因素，包括法律文化体系以及权力关系，终将对译者的心理产生影响，进而影响最终的法律译本。

A Study of the Cultural Elements in Legal Translation-sampled by the Translation of the Basic Law of HKSAR

This paper analyzes critically the translation of the HK basic law, exploring for the possi- ble theoretical and contextual influences underlying the decision making process of the legal transla- tion. It is concluded that legal translation interacts with culture, and the original intention and legal effect should be prioritized instead of the semantic meaning. Therefore, the translator is always more liberal when making linguistic decisions, and more literal when it comes to legal decisions. While making these decisions, the cultural elements of language, legal system and power relationship will more or less impact on the translator, and hence the target legal text.
