| 摘 要： | 目前我国民法对胎儿的民事权利的立法忽视导致目前许多涉及胎儿合法权利的案件得不到法律的有力支持,这一情况与我国追求现代法治精神是背道而驰的。完善对胎儿民事权利的有效立法保护应是我国目前民法典起草过程中的一项重要内容。

| Abstract: | Currently,the ignorance of the legislation of fetus civil rights in the civil law has resulted in a lack of legal support in those cases related to the lawful rights of fetus,which is against the principal of pursuing the modern spirit of ruling by law.Therefore,the perfection of legislative protection of fetus civil rights has become a major part in the drafting of current civil law code. |
