矿业权交易中矿地使用权的流转限制

长期以来，矿地使用权的取得制度是矿产研究的重点；而矿产权交易过程中，对矿地使用权的相应流转没有引起足够重视。因为矿业权和矿地使用权的分离机制，矿地使用权虽是矿业权交易的必然要求，但却独立遵守土地法规。土地法对划拨、出让、集体土地在矿业权交易中有不同限制；文章对此进行了分析，并提出了进一步的思考和建议。
