窃电取证是处理窃电问题的关键,由于电属于无形财物,对已窃电量的评估与确认,其经济性、合法性有待商榷；取证能否成功,成功后所取证据能否被固定,是寻找窃电和证明、确认窃电的决定性依据。在用电检查中,只有及时合法地查证、取证、认证和固定证据,才能有效保障查证的成功。结合法律依据,对目前有关查证取证窃电的证据提取问题、现场鉴定问题进行研究与分析,以提高用电稽查人员的办案成功率。

The key to deal with electricity power stealing is to collect evidence.Because electricity belongs to intangible asset, the assessment and confirmation of stolen electricity and its econ- omy and legality need to discuss.Whether collecting evidence can success and whether the evidence can be regularized after collect- ing evidence successfully are decisive factors to check and affirm electricity power stealing.In power utility check,the success of verification comes from verification,collecting evidence,attesta- tion,regularizing evidence according to law in time.Combining law basis,the paper analyzes and does research on the problems about evidence abstraction and scene identification in investigat- ing electricity stealing.It will improve the successful rate of checking power consumption.
