| 摘 要： | 对于次道德这种新发现的社会现象,社会上有些人对其存在着误解和疑惑。本文认为,实事求是地理性分析这种社会现象的实质、表现形式、存在的必然性,可以帮助人们正确理解和接受这种社会现象;除此以外,肯定其意义并从刑法的目的和任务、刑法的基本原则和刑法的裁量情节等方面探析其刑事法理依据,这对适度地惩罚违法犯罪行为,弥补刑事立法的不足,并促其进一步完善也有着重要的现实意义。

| Abstract: | Some people has misunderstanding and doubt to the newly discovered social phenomenon such to sub-morals in the society.This paper thinks,analyze the essence,form of expression,certainty existing of this kind of social phenomenon in geography that seek truth from facts,can help people to understand and accept this kind of social phenomenon correctly;Besides this,affirm its meaning and from purpose,task and basic principle and plot respect analysis criminal legal principle basis,this criminal offence to punishing appropriately,remedy the deficiency of the criminal legislation,urge it to perfect and have important realistic meaning to further. |
