论未成年刑事被害人的刑法保护

近年来针对未成年人的犯罪行为一次次挑战着人们的道德底线,在社会各界引起了广泛的关注。人们关注对此类案件犯罪人的判决结果,探究犯罪分子实施犯罪的原因,并思考如何预防类似案件的再次发生。探讨的视角涉及刑法学、刑事诉讼法学、犯罪学、社会学等方面。从刑法学视角入手,通过分析热点案例,探讨我国现行刑法针对未成年刑事被害人的犯罪相关罪名设置的全面性及量刑情节规定的合理性,以期能使刑法对未成年刑事被害人有更全面的保护。

On the Law Protection of Underage Criminal Victims

Many criminal cases are related with weak juveniles, such as Zhou Xijun theft infanticide, and fell in- fanticide case in Beijing. These criminal acts challenged the people＇s moral bottom line again and again and have aroused widespread concern and discussion. People always concern the offender＇s verdict, explore the criminal reasons and think how to prevent similar cases. Perspectives of the discussion for such cases involve criminal law, criminal procedure law, criminology, sociology. This paper is intended to study the hot criminal cases from the perspective of criminal law to investigate if the related charges to the juvenile victims under the current criminal law are comprehensive and sentencing provisions are reasonable in the expectation of providing more comprehen- sive law protection to juvenile crime victims.
