关于统一破产法适用范围的思考

破产法的适用范围是我国当前建立统一破产法中争议较大的一个问题 ,本文对争议最大的自然人破产能力的问题进行分析 ,指出当前全面赋予自然人破产能力缺乏经济基础以及法理依据 ,提出我国统一破产法应该采取的立法模式。

Thoughts on Unification of Application Scope of Bankruptcy Law

The application scope of the bankruptcy law is a gre at est controversial issue when our country sets up a unified bankruptcy law at pre sent. This thesis analyzed personal capacity of bankruptcy, pointed out that man y countries in the world have entitled the capacity of bankruptcy to individual while China has not kept in pace with this due to lack of economic base and lega l principle basis at present, suggested that the legislative mode should be adop ted to unify the bankruptcy law in our country.
