| 摘 要： | 由于相关法律缺位或过于原则,触电人身损害赔偿案件审判成为难点.这种局面有望随着<关于审理人身损害赔偿案件若干问题的解释>的实施有所转变.本文结合该解释提出了认定此类案件当事人责任的正确思路,包括高压电的涵义、因高压电造成的人身损害赔偿的责任主体、免责情形以及赔偿范围等.

| Abstract: | To determine the compensation for personal injuries caused by electric shock through legal procedures is now difficult ude to lack of specific law.This situation is expectde to be improve as"The Clarification of Some Problems Concerning the Trail of Compensation for Personal Injuries"made by the Supreme Court takes effect..This paper,based on the Clarification,proposes aproper way to confine the responsibility of high voltage,the determination of the principle part responsible for the injury,and to what extent and how much he is to compensate for his fault or wrong. |
