强化虚拟社会管理与健全网络立法研究

虚拟社会管理需要基本秩序,而法治是维持秩序的第一手段。分析虚拟社会管理面临市场主体、网络信息、知识产权、用户隐私权、网络犯罪等典型法律问题,针对我国现有立法有限,作用也有限的现状,提出相关立法措施,包括:做好虚拟社会管理立法顶层设计;强化虚拟社会主体素质;规制虚拟社会中不良信息;推行虚拟社会实名制;形成防范虚拟社会犯罪的科学立法体系等。

On Strengthening Virtual Social Management and Perfecting Network Legislation

Virtual social management needs basic order, and the rule of law is the first means to maintain order. After Analyses of the social management which faces virtual market main body, network information, intellectual property rights, user privacy, network crime and other typical legal problems, based on the fact that the existing legislation and its role is limited, the paper puts forward relevant legislative measures such as better virtual social management legislation top design, strengthening the virtual social subject quality; better virtual social regulation of bad in- formation, conducting virtual real society, forming virtual social crime prevention science legisla- tion system and so on.
