| 摘 要： | 采用逻辑划分的手段对民事证明责任倒置形态进行分类,可以得到动态与表态、裁量与法定、经验与逻辑的证明责任倒置。民事证明责任倒置的形态构建深化了证明责任倒置的理论研究,并从理论的高度指导证明责任在诉讼实践中的分配和适用。实践证明,责任倒置已由动态到静态、由裁量到法定、由经验到逻辑的司法———立法———司法演进。

| Abstract: | Proved burden reversion of dynamic &superficial state,discretion and legality,experience and logic can be attained by adopting logic division to classify reversion form of burden proof in civil procedure.The construction of reversion form of burden proof in civil procedure deepens the theoretical research and instructs the distribution and application of burden proof in lawsuit practice from theoretical height.Practice has proved that burden reversion has evolved from dynamic state to statistic state,from discretion to legality,from experience to logic with the way of judicature-legislation-judicature. |
