| 摘 要： | “入世’将给我国经济带来机遇的同时,也不可避免地给诸产业带来冲击,但更为深刻的冲突将发生在体制层面,尤其集中在经济法律制度方面。建立一套与WTO规则相衔接的经济法律制度应是我国立法工作的当务之急。本文从 WTO的基本原则入手,分析我国反垄断立法的现状,指出制定反垄断法的紧迫性及现实意义,并在不违背WTO基本原则的前提下,就制定有中国特色的《反垄断法》进行了思考。

| Abstract: | China's accession to WTO may bring profitable opportunities and pose challenges to our economy, while it seems that our existing economic and legal systems are in deep conflict with WTO. Hence, it is of great necessity to improve our existing systems so as to keep pace with WTO. With special emphasis on the enactment of anti-monopoly law to be in line with WTO's basic regulations, this paper tries to put forward suggestions for the formulation of anti-monopoly law with Chinese characteristics without defiance of basic principles of WTO. |
