行政复议范围是指行政相对人认为行政机关做出的行政行为侵犯其合法权益,依法可以向行政复议机关请求重新审查的范围.从比较<行政复议条例>和<行政复议法>在复议范围的发展变化方面入手,分析了行政复议范围的发展扩大的趋势和原因,并比较了同为行政救济制度的行政诉讼制度的受案范围及其发展变化,在此基础上讨论了行政复议范围扩大后需要解决的问题.

Scope of Administration Reconsideration

The scope of administrative reconsideration is so defined that a citizen can claim and turn to reconsideration agencies for review when he thinks his legal rights are infringed by administrative decision. By comparing changes of Administrative Reconsideration Ordinance with those of Administrative Reconsideration Law, analysis is made of scope enlargement and its cause. The scope of administrative procedural system and its development is also compared. Based on the above, elaboration of problems are presented for examination.
