论商品房买卖中的诚信缺失及惩罚性赔偿

摘    要:诚信缺失已经成为一种社会问题,在商品房买卖中也同样存在较为严重的诚信缺失现象,主要表现为:“先卖后抵”、“一房数卖”的恶意违约情况以及欺诈行为,对此应该采取返还已付购房款、并按已付购房款进行惩罚性赔偿等措施,予以惩戒。

Abstract:The lack of sincerity has already become a social problem.In buying and selling of commercial houses,there is also the same lack of sincerity which embodies mainly:"selling and then mortgage"of a house,"several sellings of a house"in the evil breach of an agreement or a willing deception.Because of the above,some punitive methods ought to be made by way of money return and paying damage according to the money paid for the house.
