| 摘 要： | 鉴于高层楼盘"围攻"城市公共开放空间的现象不断出现,首先讨论与眺望权相联系的民事法律关系及理论,分析城市景观的资源价值及其配置方式.进而提出,在市场经济利益主体多元化的条件下,城市规划工作要有清晰的财产权益意识并关注"景观眺望权"的经济意义,同时还要改进和完善规划的编制和管理方法.

| Abstract: | The disputes on view-rights in urban development are quite often in now-days Chinese cities. From civil-law point view the paper discusses the rights of view and analyzes the value of urban landscape and its allocation. Then the paper argues that, under market economy with multi-interests entities, urban planners must have the sense of property rights including view-rights, and the approaches of plan making and development control must to be improved accordingly. |
