| 摘 要： | 当前,城市快速发展促使规划频繁调整,在控规“法定羁束”及《物权法》实施的背景下,如何取得历史许可与现行控规冲突时公私利益的平衡,已成为规划管理中不可避免且需要经常面临的棘手问题.现从广州典型案例出发,剖析控规实施中历史许可冲突的困境与具体原因,通过借鉴国内外经验,分别从“提供权益对等平台、规范正在编制控规地区的规划许可程序、制定控规实施中历史许可冲突的发展原则、采取多种协调方式”等四方面提出建议,通过法制化途径实现公私对峙向公私博弈的转变.
